Despite carrying out false propaganda by the government Gen. Sarath Fonseka has no legal obstruction to be elected a Member of Parliament says General Secretary of the DNA Vijithe Herath. Quoting the Constitution Mr. Herath pointed out that Gen. Sarath Fonseka does not have any barrier to be elected to the Parliament.
Speaking at a press conference held at the head office of the Democratic National Alliance (DNA) today (5th) Mr. Herath said, “During the last presidential election the government carried out false propaganda. They said casting a vote for Gen. Sarath Fonseka would not be of any use as his name was not in the electoral list. It was a very serious statement and a serious crime. The government should have apologized to the people regarding making such a statement.
The liar of the government who spread such blatant lies has come out with another fabrication this time. He had said Gen. Sarath Fonseka will not be able to enter parliament and votes cast for him would be useless. This shows this man’s idiocy. He has no knowledge of the law of the country.
Also, there is a very serious matter in his statement. He had said Gen. Sarath Fonseka would be sent to jail for six months anyhow. There are no charges against Gen. Sarath Fonseka. The attempt of the government is to send him to jail somehow. This is not a matter that could be ignored.
Since the time Gen. Sarath Fonseka was appointed the Commander of the Army the tiger organization strived hard to assassinate him. They sent suicide bombers to murder Gen. Sarath Fonseka before they attempted to murder leaders of the government. Karuna and KP, known as the new leader of the tiger organization still dream of assassinating Gen. Sarath Fonseka. It is their contract that the government is carrying out now. They are trying to harm Gen. Sarath Fonseka due to their greed for money, ships and gold that belongs to tiger organization. This is why they are having KP and Karuna on their side. We call upon the people in this country to defeat this sinister interest of the Rajapakse regime and its henchmen.
On the other hand there is no reason why Gen. Sarath Fonseka could not enter Parliament. According to the Constitution a person who had been sentenced by a civil court and had languished in a jail for six months would not be able to contest at an election for seven years. There is no case against Gen. Sarath Fonseka in any civil court. Hence, there is no obstruction for him to be elected a Member of Parliament.
Now take the character of the gentleman who comes out with this fabrication. There are a number of cases against him. There is a case against him for stealing documents of the Central Committee of the JVP and robbing intellectual property that belongs to the JVP. The non-cabinet minister of culture of the government is the main suspect of a murder case. Next, Keheliya Rambukwella who was a minister of the government carried out his election campaign from the prison. Mr. P Chandrasekran contested the election from the prison.
However, chapter 14 of the Constitution states a person cannot contest an election if such a person is found or declared to be of unsound mind. According to this clause this liar would not be able to enter Parliament.
The government asks for 2/3rd majority to change the preferential system. The preferential system is not an issue for the masses. It is an issue for political parties. The issues masses have are burning economic and social issues. 11 months have gone by after ending the war. Not a single issue in the country has been solved yet.
We invite masses to give the opposition the power to inactivate the executive power. Then the country could have democracy and freedom. Vote for the ‘Trophy’ to achieve this.
